From the Captain's Chair: The Show Must Go On

The year started simple enough with Lori Wheeler being named Vice President of the Association in January. At the time, if you had told any of us how 2020 would turn out, we probably would have laughed and suggested you write a science fiction novel. With the presidential election on the horizon, we - like many others - expected the coming 12 months to simply be a flat year or slightly down for the marine industry.

March began with our 43rd Broward County Waterway Cleanup on the first Saturday of the month (the last pre-COVID live event for any of us for a long while). How quickly everything changed.

After the initial panic phase of witnessing how a little-known virus called COVID-19 could wreak such widespread havoc in every area of our lives, we pivoted and created a “new normal” - one that recognized the unique challenges our industry faced. We revised our work habits (remote offices became the norm), and refocused our efforts in areas where we could make the most impact.

We’ve long believed that you can’t ask for help when you need it if you’re not at the table the rest of the year. That’s why we’ve always placed an emphasis on nurturing relationships with elected and appointed officials at all levels of government. As March segued into April, these strong, existing relationships proved invaluable in 2020.

Utilizing relationship capital, MIASF successfully educated and advocated to keep the marine industry as “essential” and keep our businesses open. This provided predictability and income for our businesses. While many industries suffered the negative economic impact from shut-downs, the south Florida marine industry adapted and thrived.

We also turned our attention to other events adversely impacted by the coronavirus’ relentless siege. We quickly realized our annual meeting required a different format. With Reggie Rivers as the host, we enlisted the help of Media Lab to live stream the event, making it one of the first of its kind at the time. We then created a virtual “Battle of the Boats” replacing the annual Plywood Regatta to continue engagement for online students about the marine industry. Another exciting milestone in June was our Salty Jobs video series, produced by Megan Piggott, winning a Telly award!

Summer came and in Orlando we watched as Universal Studios and Disney World reopened safely, seeing 10,000 to 30,000 guests per day while following best practices.

With our most important consumer-facing event of the year slated to occur in the fall of 2020, we turned to Informa’s team of event organizers to ensure FLIBS would remain an in-person event. Utilizing the “All Secure” program, a universal/global set of standards, allowing people to enjoy a live event that - aside from masking and social distancing - harkened back to pre-pandemic experiences.

To be sure, 2020 was a challenging year for all of us. It forced us to adapt, step outside our comfort zone and find solutions to problems we never before imagined. Yet, we rose to the challenge, and the show went on. While nobody knows with certainty what 2021 will bring, MIASF is confident we will embrace - and conquer - any challenges the new year has in store. We’re making decisions, not COVID-19.

Advocacy Report

Advocacy Report

The Florida Keys National Marine Sanctuary was established in 1990 to protect the sensitive environment of the world’s third largest barrier coral reef. Several years after the establishment of the sanctuary there were a number of high-profile groundings with extensive damage prompting a regulation prohibiting any vessel over 50 meters to enter the sanctuary. This is a federal regulation which Florida Fish and Wildlife has been charged with enforcement. Be sure to mention this to any yacht over 165’ planning a trip to the Keys in a proactive step to prevent a bad experience.

The next phase in the New River Bridge Study is scheduled to begin in the new year. Broward County and Brightline are in discussions on use of commuter rail along the FEC corridor following last month’s agreement with Miami-Dade. The Miami-Dade agreement is $50 million initial payment and $12 million annually. Current train bridge regulations are in the final stages of the federal approval process. The US Coast Guard (USCG) is working on a modification to better clarify the intent of minor repairs.

The ability of yacht crew to find an open US Consulate issuing visas continues to be a challenge and it is anticipated to continue to be difficult as countries enhance regulations to control the current spike of COVID-19. We are monitoring for possible changes to the current rule recognizing yacht crew as exempt from the US travel ban as essential workers as it was part of a presidential order. On January 20th our new president may have a different view on this policy. It is recommended that any vessels coming up on crew rotation should try and complete their travel before 1/20/21.

USCG Headquarters has been in discussion with Sector Miami to assist in drafting the 300gt US flag regulation proposal. MIASF has agreed to help develop the local large yacht knowledgeable working group. Meetings will be scheduled at the beginning of the new year.

In January MIASF will partner with the Water Taxi to provide the Broward Legislative Delegation with a waterway tour of the New River. Representatives who take advantage of this opportunity to learn about the issues and concerns of the marine industry before heading to Tallahassee in March should be commended for their willingness to learn about our issues.

The ABYC Foundation announced this week the 2020 Educator of the Year - Stephen Spencer from Palm Beach State College (PBSC) in Lake Worth, Florida. The ABYC Foundation’s Educator of the Year award was established to honor extraordinary instructors who are shaping future marine service technicians.

Spencer, a native of Louisville, Kentucky, began his teaching career in 2001 after retiring from a 31-year career in the U.S. Coast Guard, rising to the rank of Command Master Chief. According to Marquez, after meetings in 2018 with the local workforce taskforce, Spencer organized to get the program up and running by August 2019.

Just this fall, amid the challenges of holding class within COVID, Spencer’s first class of 14 graduated from the program. As he shared with his students, “You now have all the pieces of the puzzle in your hands. It’s up to you to put all those together so you can be successful in business.”

Spencer, as the 2020 ABYC Foundation Educator of the Year winner, will receive an award, gift certificate from Harbor Freight, a free ABYC professional certification class and free registration for the next ABYC Education Training Conference.

Boat Owners Association of The United States (BoatUS) is advising boaters with vessels that have a U.S. Coast Guard Certificate of Documentation to be wary of any letter arriving by U.S. mail offering renewal.

BoatUS advises that while the Coast Guard does send official annual renewal notices by U.S. mail, other notices being received by members are not from the Coast Guard but rather third-party companies whose name or return addresses may appear similar to that of the official U.S. Coast Guard National Vessel Documentation Center (NVDC).

BoatUS members have complained that these letters direct them to websites that may be mistaken for the actual Coast Guard NVDC located in Falling Waters, West Virginia, and appear to show a significant increase in the annual fee to renew Coast Guard documentation.

In 2017 the Coast Guard issued a bulletin that says in part:

“The NVDC is aware that there are commercial entities that offer to manage the certification/renewal process on behalf of vessel owners for a fee. The Coast Guard does not endorse any of these companies, and the companies do not operate on behalf of the Coast Guard in any way. Any fees charged or agreements offered by such companies are in no way associated with the NVDC certification process. In addition, these companies are not authorized to issue any form of documentation, including travel letters and/or permits that authorize operation of ANY vessel. Customer complaints can be made through the Federal Trade Commission's (FTC) website at https://www.ftc.gov/.”

While third-party companies may legitimately provide services to assist with vessel documentation renewals, the Coast Guard’s own renewal process is simple for most vessels and the price, $26 annually, is often much lower than what third-party services may charge. To renew, go to the Coast Guard National Documentation Center website at https://www.uscg.mil/nvdc and click on “instructions and forms,” then “Certificate of Documentation Application for Renewal.” BoatUS notes that the Coast Guard NVDC now also offers renewal options up to five years for recreational vessels only.

To be documented, a vessel must measure at least five net tons and, with the exception of certain oil-spill response vessels, owned by a U.S. citizen. Boats about 27 feet in length or longer generally meet the weight requirement.

BoatUS also advises boaters who may have received mail that they believe is misleading or deceptive to contact the U.S. Postal Inspection Service at 877-876-2455 or through its website https://postalinspectors.uspis.gov.
